Theological Foundations of the Rational Proofs of Hisbeh for Faqih Guardianship in Imam Khomeini and the Supreme Leader`s System of Thought

Abstract

 
The background of the proofs of faqih guardianship turns lies in the period of minor absence and the age of Sheikh Mofid. On the principle of faqih guardianship, during the Imam`s absence the administration of Muslim affairs is just faqih`s duty and, as viewed by the late Imam Khomeini and the supreme leadr, hesbeh is a proof for the principle. Comparing the two leaders views on in the field, the article has intended to prove the proofs` closeness for supporting the principle. The method of study is ratio-analytical and, regarding the inni quality of the proof of hisbah, the leaders` views have been studied. As concluded in the article, the theory of hesbeh is among the clear proofs for establishing Islamic government and the most essential case of hisbah consist of establishing a just political system on the basis of Divine laws with the leadership of a just faqih with all religiously determined conditions. Such being the case, the establishment of Islamic system of political government would be the necessary ground for the theory of hisbah like all other Islamic social and political rules.

یرجع تاریخ دراسة أدلة ولایة الفقیه إلى عصر الغیبة الصغرى و عصر الشیخ المفید. و بنائاً على هذه النظریة یتولی الفقیه العادل أمور المسلمین؛ و عند الإمام الخمینی و السید الخامنئی یعتبر دلیل الحسبة إحدى طرق إثبات ولایة الفقیه. تحاول هذه المقالة مقارنة رأیی الإمام الخمینی و قائد الثورة الإسلامیة و عرض المشابهة بینهما فی استخدام الحسبة فی إثبات ولایة الفقیه. منهج المقالة عقلی-تحلیلی و نظراً إلى کون دلیل الحسبة من نوع البرهان الإنی، نقوم بتحلیله علی أساس رأیی الإمام الخمینی و قائد الثورة. و نتیجة المقالة أن دلیل الحسبة من أظهر الدلائل لإقامة الحکومة الإسلامیة و من أهم المصادیق للأمور الحسبیة استقرار نظام سیاسی عادل مبتن على القوانین الإلهیة بقیادة فقیه عادل جامع للشروط. على هذا الأساس نظریة الحسبة مفروض فیها وجود الحکومة و نظام سیاسی؛ و هکذا الکثیر من أحکام الإسلام السیاسیة و الاجتماعیة.
